STANDARD TERMS AND CONDITIONS (VIVAVIOLAS GUEST HOUSE)

1) Who We Are (Seller / Host)

These Standard Terms and Conditions (“Terms”) apply to all reservations, bookings, invoices, purchases, and services provided by VivaViolas Guest House (“VivaViolas,” “we,” “us”). 2) Scope of Services

VivaViolas provides guest house accommodation and may offer or coordinate additional services, including (where available):

  • In-house dining (meals prepared to order; beverages may be sold separately)
  • Laundry services
  • Transportation, tours, and deliveries coordinated through trusted third-party partners (including PortlandJamaicaTours.com)

Service availability may vary based on staffing, weather, seasonal ingredients, and local conditions.

3) Reservations, Confirmation, and Guest Eligibility

A reservation is confirmed only when we provide written confirmation (email, invoice, or booking confirmation). The person making the booking represents that they are authorized to do so and accepts these Terms on behalf of all guests in the party.

We reserve the right to refuse or cancel a booking where permitted by law, including for safety, capacity, rule violations, or suspected fraud.

4) Rates, Taxes, and Quotes

Rates are provided at the time of booking and may depend on dates, occupancy, and selected services. Any taxes, fees, or required charges will be shown on the invoice/booking confirmation where applicable.

If prices are listed on menus or service sheets, they are subject to change; your confirmed invoice/booking confirmation controls.

5) Payment Terms

Payment timing and method will be stated on your booking confirmation or invoice. Unless otherwise stated in writing:

  • Accommodation must be paid by the deadline shown on the invoice/confirmation (or, if none is shown, payment is due no later than check-in).
  • Add-on services (e.g., dining, laundry, special requests) may require prepayment and/or payment upon delivery of the service.

If payment is not received by the due date, VivaViolas may (a) cancel the reservation, (b) suspend services, and/or (c) refuse check-in, subject to applicable law.

6) Late Payment, Interest, and Recovery Costs (Where Applicable)

If an invoice remains unpaid after the due date, VivaViolas may charge interest and recovery costs to the extent permitted by Jamaican law and applicable consumer protection rules. We may also suspend services until the account is brought current.

7) Cancellations, No-Shows, and Changes

Cancellation and modification rules (including any applicable fees or non-refundable amounts) will be stated on your booking confirmation, invoice, or the channel you booked through (e.g., direct booking terms vs. third-party booking platform terms). If there is a conflict, the terms shown at the time of booking will apply.

No-shows or early departures may be charged in accordance with the agreed booking terms and the rate plan booked.

8) House Rules & Safety Rules

Standard times (unless otherwise confirmed in writing):

  • Check-in: 3:00 PM to 10:00 PM
  • Check-out: 11:00 AM latest

Guests agree to comply with house rules and safety rules. We may terminate a stay (without refund where permitted) for serious rule violations, illegal activity, threats to staff/guests, or property damage.

9) Occupancy, Visitors, and Use of Property

Only registered guests may stay overnight unless explicitly approved in writing. Day visitors may be restricted. The property is for peaceful guest use; events/large gatherings require prior written approval.

10) Guest Responsibility, Damages, and Extra Cleaning

Guests are responsible for:

  • Damage to rooms, furnishings, linens, or common areas beyond normal wear
  • Missing items
  • Excessive cleaning needs due to misuse

We may charge reasonable repair/replacement/extra-cleaning costs and any associated administrative costs, supported by receipts/estimates where available.

11) Dining and Food Service Notes

Dining is offered as an in-house service when available. Menus may change based on seasonal ingredients and supply.

Guests must inform VivaViolas of allergies/dietary restrictions in advance; we will take reasonable care but cannot guarantee a fully allergen-free environment.

12) Laundry Services

Laundry is available where offered and is priced based on quantity/type.

We take reasonable care; however, we are not liable for damage due to pre-existing garment conditions, manufacturer defects, or items that require special handling unless we explicitly accept them in writing.

13) Third-Party Services (Tours, Transport, Deliveries)

Some services are coordinated through independent third parties (including PortlandJamaicaTours.com).

When you purchase or use third-party services:

  • The third party is responsible for performing the service
  • Their own policies (availability, pricing, cancellations, refunds, liability) apply
  • VivaViolas is not liable for third-party changes, cancellations, delays, disputes, injuries, or losses related to third-party services, to the extent permitted by law

14) Force Majeure

VivaViolas is not responsible for delays or failure to perform caused by events beyond reasonable control, including severe weather, natural disasters, power/water outages, road closures, governmental actions, or other emergencies. Where possible, we will work with guests to provide alternatives or reschedule, but refunds/credits will follow the booking terms and applicable law.

15) Limitation of Liability

To the maximum extent permitted by Jamaican law:

  • VivaViolas is not liable for indirect or consequential loss (e.g., missed flights, lost income)
  • VivaViolas is not liable for loss or theft of personal items unless caused by our proven negligence
  • Any liability, where legally established, is limited to the amount paid for the affected stay/service

Nothing in these Terms limits liability that cannot be excluded under applicable law.

16) Complaints and Claims

Guests should notify us promptly of any issue during the stay so we can attempt to resolve it. If a written complaint is required, it must be submitted to booking@vivaviolas.com within 7 days after check-out, including reservation details and a clear description of the issue.

17) Withholding Taxes / Bank Charges

If any withholding tax, bank fee, or transfer cost is applied by the guest’s bank or jurisdiction, the guest remains responsible for ensuring VivaViolas receives the full invoiced amount, unless prohibited by law.

18) Governing Law and Jurisdiction

All contractual relations are governed exclusively by the laws of Jamaica. Any dispute will be subject to the competent courts of Jamaica, unless mandatory consumer laws require otherwise.

19) Miscellaneous

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with your booking confirmation/invoice and any posted house rules referenced at booking, form the entire agreement.
